The Week Ahead

This morning, the Supreme Court will release its second round of summer orders – probably consisting mainly of actions on rehearing petitions. We will post anything of general interest that appears on the list.

For cases already granted, top side briefs are due today in Sprint/United Management v. Mendelsohn (06-1221); August 23 in Rowe v. New Hampshire Motor Transport Association (06-457) and Knight v. Commissioner of Internal Revenue (06-1286); and August 24 in Boumediene v. Bush (06-1195) and Al Odah v. United States (06-1196). Bottom side briefs are due today in United States v. Williams (06-694) and United States v. Santos (06-1005), and August 23 in Medellin v. Texas (06-984).

Developments are likely during the week in D.C. Circuit Court on the government’s obligations to provide broader files of information for the Circuit Court to review as it judges the legality of military decisions to detain prisoners at Guantanamo Bay, Cuba. The Circuit Court has authority under the Detainee Treatment Act to review the rulings of Combatant Status Review Tribunals. (Note: the DTA review cases at the Circuit Court are separate from the detainee habeas cases the Supreme Court will be considering next Term in Boumediene and Al Odah.)
