The Supreme Court, at its private Conference on Friday, will consider the timing for its reaction to the two new appeals on the legal rights of detainees at Guantanamo Bay, Cuba. The Court’s electionic docket shows that the motions for expedition will be taken up this week, the first opportunity since the cases and the motions were filed on March 5.
Lawyers for the detainees and the Justice Department support expedition, and have suggested a briefing and argument schedule that would lead to a hearing on Monday, May 7. The Court, in reacting to the expedition motions, is expected to announce not only whether it will speed up the cases, but also what specific schedule it will mandate.
The detainee cases are Boumediene v. Bush (06-1195) and Al Odah v. U.S. (06-1196).
