Opinions This Week

The Court will be issuing an Orders List this morning, and will be issuing one or more opinions in argued cases both today and tomorrow.

The only two remaining opinions from the October sitting are Gonzales v. Oregon (the physician-assisted suicide case) and Garcetti v. Ceballos (an important First Amendment case concerning government employee speech). The only Justices who have not yet written majority opinions from the October sitting are the Chief Justice and Justices Kennedy and Souter; therefore two of those three are likely writing the majorities in these two cases.

Five cases remain to be decided from the second sitting, including O Centro, the RFRA case involving hoasca tea. Justices Stevens, Kennedy, Souter and Thomas have yet to issue opinions from that sitting.

It’s also possible the Court will issue one or more opinions from last month’s third sitting.
