Granted Cases

The Court this morning granted certiorari for next Term in five cases:

1. Bank of China v. NBM, No. 03-1559 — whether plaintiffs in civil RICO case alleging mail and wire fraud as predicat acts must establish reasonable reliance. (Grant limited to this question).

2. Whitman v. Dep’t Transp., No. 04-1131 — whether Civil Service Reform Act precludes suits by federal employees asserting statutory or constitutional violations relating to their employment in federal court. [Disclosure: Goldstein & Howe for petitioner]

3. Hudson v. Michigan, No. 04-1360 — Whether “inevitable discovery” doctrine creates a per se exception to exclusionary rule for evidence seized after violation of “knock and announce” rule of the Fourth Amendment.

4. Hartman v. Moore, No. 04-1495 — Whether law enforcement officers may be sued in a Bivens action for retaliatory prosecution when prosecution was supported by probable cause. (Grant limited to this question).

5. Texaco v. Dagher, No. 04-805 consolidated with Shell Oil Co. v. Dagher, No. 04-814 — Whether it is a per se illegal concerted action under Section 1 of the Sherman Act for economically integrated joint ventures to set the selling price of its products.
