Two cases granted

The Supreme Court on Monday agreed to rule on the federal government’s liability for failure to carry out safety inspections that are required by federal law. The case involves a copper mine accident in Arizona, resulting in a lawsuit against the U.S. government under the Federal Tort Claims Act. The case is U.S. v. Olson (docket 04-759).

The Court also agreed to rule on the scope of a federal law against price discrimination between purchasers. The issue is whether the law is triggered if an offer to sell is made, but is not accepted. The case is Volvo Trucks North America v. Reeder-Simco GMC (04-905).

The Court again took no action on three cases testing the constitutionality of presidential appointments of federal judges during brief recesses of the Senate.
