Issue: Whether 18 U.S.C. § 1821(b), which limits expert witness fees to $40 per day, applies to cases arising under the Supreme Court’s original jurisdiction.

Judgment: Decided, 9-0, in an opinion by Justice Samuel Alito on March 9, 2009. Chief Justice Roberts filed a concurring opinion, in which Justice Souter joined.
