Details on today’s opinion

This morning, the Court issued one opinion, AT&T Mobility v. Concepcion  (No. 09-893). By a vote of five to four, the Court reversed the Ninth Circuit, holding that California’s Discover Bank rule is preempted by the Federal Arbitration Act because it stands as an obstacle to the accomplishment and execution of the full purposes and objectives of Congress.  The opinion of the Court is written by Justice Scalia. Justice Thomas filed a concurring opinion.  Justice Breyer filed a dissenting opinion, which was joined by Justices Ginsburg, Sotomayor, and Kagan. The Court’s opinion is here.
