Sousa v. Branch Banking and Trust Company

Issue: (1) Whether NRS "40.459(1)(c), which limits the amount of a deficiency judgment that a person seeking the judgment can recover if that person acquired the right to obtain the deficiency judgment from a person who had that right is preempted by the Financial Institutions and Recovery of 1989 because the notes or mortgages in question were acquired from the Federal Deposit and Insurance Corporation; and (2) whether the NRS "40.459(1)(c) limitations on deficiency claims violate the Contract Clause of the U.S. and/or Nevada Constitutions when the notes or mortgages in question were acquired by a Third Party Purchaser prior to the effective date of the statute.
