Issue: (1) Whether the Supreme Court should resolve a split among the circuit courts by rejecting the U.S. Court of Appeals for the 9th Circuit's finding that the Americans with Disabilities Act and Section 504 of the Rehabilitation Act, 29 U.S.C. § 701, do not pre-empt a property owner's state law claim for contribution against third-party contractors, thereby enabling the owner to shift its non-delegable duty to comply with these federal civil rights statutes; and (2) whether, in enacting the Americans with Disabilities Act and Section 504 of the Rehabilitation Act, Congress evinced a legislative intent to preclude a state law cause of action of indemnity in favor of an owner of a facility found to be in violation of the ADA as suggested by the Supreme Court's holding in Northwest Airlines, Inc. v. Transport Workers.
