Brown v. Columbia Gas Transmission, LLC

Issue: (1) Whether this Court should revisit Auer v. Robbins now that at least three Justices want to do so; (2) whether, in eminent domain proceedings, courts should interpret ambiguity in statutory, regulatory, and agency authorizations for private companies to confiscate land in favor of property owners, as the Ninth Circuit has held and in line with this Court’s precedent, or whether courts should interpret statutes and regulations in favor of a private company seeking to confiscate property, as the Third Circuit majority did in this case; and (3) whether an agency’s change in position constitutes a change in controlling law that justifies reconsideration of a legal ruling.
