Marriage arguments March 26-27

The Supreme Court on Monday released the schedule of oral arguments for the sitting that begins March 18, showing that the two cases on same-sex marriage will be heard — one on each day — on Tuesday, March 26, and Wednesday, March 27. The case on California’s “Proposition 8” will come first, followed by the case on the constitutionality of the federal Defense of Marriage Act; each case is scheduled for one hour of argument, although the fact that each is to be heard alone will allow the argument time to be expanded, and that appears likely.
Hearings are set for mornings only, beginning at 10 a.m. Following the jump, the day by-day schedule shows the issue at stake in each case.
Monday, March 18:
12-71 — Arizona v. Inter Tribal Council of Arizona — constitutionality of requiring voters to prove U.S. citizenship in order to register to vote and cast ballots
11-1518 — Bullock v. BankChampaign — effect of misconduct of bankruptcy trustee on discharge of debt
Tuesday, March 19:
12-236 — Sebelius (HHS) v. Cloer — may a person who missed a deadline to make a claim for vaccine-caused injury still recover attorney’s fees and costs for pursuing the claim
12-142 — Mutual Pharmaceutical Co. v. Bartlett — must a maker of a generic drug that allegedly caused harm to a patent take the drug off the market if that is the only way it can obey both federal drug law and state drug product law
Wednesday, March 20:
12-123 — Horne v. Department of Agriculture — must processors of grapes into raisins go to a special federal court to seek payments for a part of their crop that federal rules require be kept off the market
12-52 — Dan’s City Used Cars v. Pelkey — preemption of state law regulating the sale and disposal of a vehicle that has been towed
Monday, March 25:
12-135 — Oxford Health Plans v. Sutter — intention of parties to agree to class-wide arbitration of disputes
12-416 — Federal Trade Commission v. Watson Pharmaceuticals — legality under federal antitrust law of payment by a brand-name drug maker to a maker of a generic counterpart, to delay the generic drug’s market entry (Justice Samuel Alito, Jr., is recused.)
Tuesday, March 26:
12-144 — Hollingsworth v. Perry — constitutionality of California’s “Proposition 8” ban on same-sex marriage; also, question of standing to appeal
Wednesday, March 27:
12-307 — United States v. Windsor — constitutionality of Section 3 of the federal Defense of Marriage Act’s benefits limited to married opposite-sex couples; also, question of standing for U.S. government and for House GOP leaders to appeal the case
