The Supreme Court will be closed Monday in observance of Memorial Day.
On Tuesday, the Court will release orders from the Justices’ private conference last Thursday. One or more opinions in pending cases may also be released.
The petitioner’s brief on the merits is due Tuesday in Union Pacific Railroad Company v. Brotherhood of Locomotive Engineers and Trainmen General Committee of Adjustment, Central Region (08-604), Padilla v. Commonwealth of Kentucky (08-651), and Smith v. Spisak (08-724). The petitioner’s brief on the merits is due Wednesday in Johnson v. U.S.(08-6925). No respondent’s brief on the merits is due this week.

On Friday, the Solicitor General is to file the Obama Administration’s views on the authority of the courts to order the transfer of Guantanamo Bay prisoners to the U.S. mainland to live temporarily — the central issue in Kiyemba, et al., v. Obama (08-1234).
