On June 16, the Stanford Clinic filed its opening brief on behalf of the petitioner in Melendez-Diaz v. Massachusetts, No. 07-591. The case presents the question whether a state statute, which permits the prosecution to submit a forensic lab report without putting the person who prepared it on the witness stand, violates the Confrontation Clause as construed by Crawford v. Washington, 541 U.S. 36 (2004).
