SG recommends denial in foreign suit injunction cases

This afternoon, the Solicitor General recommended the Court grant, vacate and remand the decision below in Ministry of Defense v. Elahi (07-615). The case involves whether U.S. courts can order a seizure of the assets in the U.S. of a foreign government accused of aiding terrorism, with the assets to be used to pay off a debt owed in the U.S. To read the government’s invitation brief, click here.

Earlier this morning, the Solicitor General recommended the Court deny certiorari in two cases dealing with the jurisdiction of U.S. courts to issue injunctions preventing losing parties from reversing judgments in foreign courts.
