The American Constitution Society has issued this advisory about a panel discussion of pending legislation on the trial of Guantanamo Bay detainees. The moderator is this blog’s own Marty Lederman.

WHAT: Discussion of pending legislation authorizing tribunals for detainees in the War on Terror

WHERE: U.S. Capitol Building, Room SC-4, Washington, D.C.

Since the Supreme Court ruled that the military tribunal system in use for detainees in the war on terrorism is illegal, various proposals have been offered. What are the main considerations in developing a sound and constitutional system for trying detainees? Who should be subject to trial in military commissions? What rights are at stake, and how should those be accounted for within the structure? What elements should be included in any proposal that moves forward? More broadly, will the U.S. abide by the protections of the Geneva Conventions? Should the Geneva Convention protections be enforceable in federal court? Should the War Crimes Act be amended, as some have suggested, to absolve of liability those involved in the detention and treatment of detainees since 9/11? The panel, representative of different viewpoints, will discuss these issues and more.
