Today’s Opinions

The Court issued opinions today in the following three cases:
No. 03-1039, Brown v. Payton, reversed 5-3, in an opinion written by Justice Kennedy (the Chief Justice not participating). Justice Scalia concurred, joined by Justice Thomas. Justice Breyer also filed a concurrence. Justice Souter dissented, joined by Justices Stevens and Ginsburg.
No. 03-1601, City of Rancho Palos Verdes v. Abrams, reversed and remanded 9-0, in an opinion written by Justice Scalia. Justice Stevens concurred in the judgment. Justice Breyer concurred, joined by Justices O’Connor, Souter and Ginsburg.
No. 03-1423, Muehler v. Mena, unanimously vacating and remanding, in an opinion written by the Chief Justice. Justice Stevens filed an opinion concurring in the judgment that Justices Souter, Ginsburg and Breyer joined. Justice Kennedy filed a concurrence.
