At 10 a.m., following the announcement of any orders or opinions, the Court will hear argument in Yeager v. U.S. (08-67), on whether under the Double Jeopardy Clause, the government may retry defendants acquitted of some charges on factually related counts on which the jury failed to reach a verdict. Samuel J. Buffone of Ropes & Gray in Washington, D.C. will argue for the petitioner and Michael R. Dreeben, Deputy Solicitor General, will argue for the United States.
