Petition granted, judgment vacated and case remanded for further consideration in light of Alabama Legislative Black Caucus v. Alabama on April 20, 2015
Issue: (1) Whether an explicit policy of racial balancing and race-based line drawing can be justified under the Equal Protection Clause of the Fourteenth Amendment by an incorrect view of the requirements of the federal Voting Rights Act; and (2) whether race-based districts are drawn as a safe harbor subject to strict scrutiny and required to use race no more than necessary to comply with the Voting Rights Act properly interpreted.
