Briefly:

  • At FiveThirtyEight, Amelia Thomson-DeVeaux looks at a recent study showing that “Americans’ views of the Supreme Court have grown somewhat less favorable over time, and in the past few months, an unusually large partisan gap has opened up”; she suggests that “an uptick in partisan rancor could prompt the justices to tread carefully in a year when [they] will already be addressing hot-button issues like President Trump’s effort to end Obama-era protections for young undocumented immigrants and workplace discrimination based on sexual orientation.”
  • Kevin Daley writes for The Daily Caller thatDemocratic Sen. Sheldon Whitehouse of Rhode Island filed a legal brief before the Supreme Court in a challenge to New York City’s gun transportation regulations, advancing a broad indictment of the Roberts Court itself as he urged the justices to turn away the NRA-backed case.”
  • At On Labor, Jonathan Harkavy notes that “[t]he upcoming Supreme Court term is already brimming with consequential employment law issues on its argument docket,” including “a trio of retirement plan cases [that] may affect the scope and manner of ERISA regulation of retirement benefit plans,” which “arrive at a critical time, just as the boomer generation is leaving the workforce and beginning to live on their expected retirement benefits.”

  • At the Chicago Daily Law Bulletin (subscription required), Daniel Cotter discusses a recent cert petition in which the federal government has “asked the court to find that undocumented immigrants subject to ‘expedited removal’ have no constitutional right to judicial review of asylum claims under the suspension clause.”
  • In the latest episode of SCOTUStalk, Amy Howe talks to veteran Supreme Court litigator Paul Smith about oral advocacy before the court.
