Tuesday round-up

Yesterday the late Justice John Paul Stevens lay in repose in the Great Hall of the Supreme Court, attended by former clerks and after a brief ceremony that included remarks by Justice Elena Kagan, who succeeded Stevens on the court. Mark Walsh has this blog’s coverage. For The Washington Post, Roberts Barnes and Cortlynn Stark report that “Kagan was joined by Chief Justice John G. Roberts Jr. and Justices Ruth Bader Ginsburg, Samuel A. Alito Jr. and Sonia Sotomayor.” Jess Bravin reports for The Wall Street Journal that “President Trump and first lady Melania Trump [paid] their respects, despite Justice Stevens having voiced concerns over the administration’s refusal to comply with congressional subpoenas.” In another article for the Journal, Bravin offers excerpts from a recent interview with Stevens about the late justice’s most recent book, “The Making of a Justice: Reflections on My First 94 Years.”

  • According to Chris Johnson at The Washington Blade, a “new petition filed before the U.S. Supreme Court on behalf of a Catholic adoption agency seeking to refuse placement into LGBT homes calls for a ruling that could enable anti-LGBT discrimination in the name of ‘religious freedom’ — even if justices affirm in separate pending litigation LGBT protections are included under federal civil rights law.”
  • Kevin Daley reports for The Daily Caller that “[e]nvironmental groups and House Democrats [are urging] the Supreme Court not to disturb a lower court order blocking the reallocation of military funds for border wall projects.”
  • At the Chicago Daily Law Bulletin (subscription required), Daniel Cotter writes that a new book on the confirmation of Justice Brett Kavanaugh has drawn attention by referring to retired Justice Anthony “Kennedy’s input on future Supreme Court justices during 2016 while Trump was a candidate.”
  • The latest episode of Strict Scrutiny (podcast) includes discussions of “the Court’s death penalty docket, the Armed Career Criminal Act cases from this past term, and Justice Kavanaugh’s opinion in Flowers v. Mississippi.”
