Today in the Community: January 18, 2012

Today in the Community we consider some of Justice O’Connor’s decisions that have been modified by the current Court. Examples include the area of reproductive rights, where the Court in Gonzales v. Carhart stepped away from Justice O’Connor’s opinion in Stenberg v. Carhart; in the area of campaign finance, where the Citizens United decision partially overruled McConnell v. FEC; and in the area of affirmative action, where the Court’s decision in Parents Involved arguably marked a departure from Justice O’Connor’s opinion in Grutter. We’re interested to hear your thoughts on how these more recent decisions interact with Justice O’Connor’s approach to the same subjects, and also to get your views on other areas in which Justice O’Connor’s opinions may have been modified or pared back.
