  1. NY Board of Elections is probably the only time this term we’ll see a Kennedy opinion at the end of the line. But what good is Breyer’s partial join of Kennedy’s opinion when he only joins in the dicta? Just kissing up to Kennedy, I guess.

  2. Chief Justice Roberts has now written two unanimous opinions on dreadful topics from the November and December sittings. I think this strongly suggests he is writing something big in Medellin v. Texas, which remains outstanding from the October sitting. If the conservatives won, he’s writing the majority. If the liberals won, he’s writing a lead dissent to Breyer’s majority (and not writing a majority opinion for October, where there will be only eight full-blown opinions).
