  1. Re Zunisotto voce, “wow.” Reports of the demise of the paint-melting Scalia dissent were evidently premature. This dissent is nuclear, start to finish.

  2. Watters may be the first opinion of the Kennedy Court. With Roberts, Stevens and Scalia in dissent, he made the assignment.

    It’s clear that what the Court needs to overcome its image of partisanship is more business cases. Here’s Stevens joining Roberts and Scalia on federalism grounds, Souter joining a Scalia dissent, and Alito teaming up with Breyer and Ginsberg.

    BTW, the Wisconsin US Attorney who is a poster child for Bushieness in the current Gonzalez contretemps, Steven Biskupic, is the brother of USA Today Supreme Court reporter Joan Biskupic (a distinction shared by 7 others).
