Sidley has, indeed, had a very busy year at the Court. In fact, the morning of the argument in Mohawk, the Court handed down a decision in a case Mr. Phillips argued earlier in the term (Jones v. Flowers).

I hope this isn’t off-topic, but it this is something like the third case in the past month that Carter Phillips has argued at the Supreme Court (the others being eBay v. MercExchange, and another whose name escapes me). Is this just a coincidence, or is Sidley drowning in Supreme Court work? I understand that Carter Phillips has done 50 or so of these and is part of the “Supreme Court bar,” but even the veterans don’t seem to argue quite this often unless they’re in the SG’s office.

I wrote a law review article on the very issue presented in this case at 80 Notre Dame Law Review 781 (2005). If you are interested in this arcane issue in the law of RICO it might be worth reading (though I don’t know how insightful it will be.)
