The Week Ahead

No oral arguments are scheduled at the Supreme Court this week.

By Thursday, the government is expected to file its response to the petition for certiorari in al-Marri v. Pucciarelli (08-368), a habeas challenge by the only “enemy combatant” apprehended and held on U.S. soil. For more on the case, including links to the petition and ruling below, click here.

On Friday, lawyers for a set of Guantanamo detainees are expected to respond to the government’s petition for rehearing en banc in Bismullah v. Gates, on the scope of the D.C. Circuit’s review power over military detention decisions by Combatant Status Review Tribunals. For more on the case, including a link to the rehearing petition, click here.

No merits briefs for petitioners are due this week. Merits briefs for respondents are due Wednesday in Fitzgerald, et vir v. Barnstable School Committee, et al. (07-1125) and Friday in Ashcroft v. Iqbal (07-1015).
