The Week Ahead

The Court is in recess for the summer. The opening conference for next term will take place September 29. Oral arguments will resume October 6.

On Tuesday, the Washington Legal Foundation will host its annual preview panel for the upcoming term (see here). On Wednesday, the Cato Institute will host a preview panel as part of its Constitution Day program (see here).

On Wednesday afternoon, counsel for Patrick Kennedy and for the Justice Department are to file briefs on the issue of rehearing Kennedy v. Louisiana, the decision striking down the death penalty for the crime of child rape, and, on the issue of what to do about the decision if rehearing is granted.  Louisiana has sought rehearing.  A post discussing the rehearing issue, with a link to the Court’s briefing order, can be read here.

The petitioner’s brief on the merits is due Wednesday in Coeur Alaska, Inc. v. Southeast Alaska Conservation Council, et al. and Alaska v. Southeast Alaska Conservation Council, et al. (07-984/07-990). The respondent’s brief on the merits is due Monday in United States v. Eurodif (07-1059) and Tuesday in United States v. Hayes (07-608).
