The Week Ahead

The Court will hear oral argument in the following cases:

Mon., Dec. 7:

  • Free Enterprise Fund and Beckstead and Watts, LLP v. Public Company Accounting Oversight Board (08-861) — constitutionality of Sarbanes-Oxley Act’s creation of accounting review board
  • Florida v. Powell (08-1175) — police duty to expand “Miranda warnings” before questioning suspect

Tues., Dec. 8:

  • Black v. United States (08-876) — application of “honest services” fraud law to private conduct
  • Weyhrauch v. United States (08-1196) — proof needed in state official’s “honest services” fraud trial

Wed., Dec. 9:

  • Stolt-Nielsen S.A. v. AnimalFeeds International Corp. (08-1198) — scope of right to arbitrate as class action

On Friday, merits briefs are due for the petitioners in Skilling v. United States (08-1394) and Health Care Service v. Pollitt (09-38).  The reply brief in Conkright v. Frommert (08-810) is also expected at the end of this week.

Also on Friday, the Court will hold their last private conference before the new year.
