I represent Kay Staley in Harris County v. Staley. Harris County's cert petition raises more than one issue. The primary issue the County raises is whether the defendant is entitled to vacatur of an unfavorable district court decision when the defendant moots the case by voluntary action unrelated to the litigation. The issue you mention on your blog -- whether the plaintiff is entitled to attorneys' fees when a case becomes moot on appeal -- is raised by the Petition but only secondarily.
