		<description>How often does a case get dismissed right before the Court hears it? At this point in the litigation, haven&#039;t both parties gamed out the cost-benefit analysis of settlement/appeal/etc? Also, given that the Court may well hear this case&#039;s companion case soon, I don&#039;t see that BCI might just have decided that it would be better to maintain the Circuit split on this issue rather than submitting to the Court.

Is there any speculation about why BCI made this decision?
