At this point in the litigation, haven't both parties gamed out the cost-benefit analysis of settlement/appeal/etc? Also, given that the Court may well hear this case's companion case soon, I don't see that BCI might just have decided that it would be better to maintain the Circuit split on this issue rather than submitting to the Court.
