		<description>It&#039;s not clear that the judges in the Mikva brief anywhere actually refer to themselves as &quot;Judge Mikva&quot;, etc. (though they do identify themselves as former federal judges and use &quot;Honorable&quot;)  Perhaps the use of &quot;Hon.&quot; was inadvisable.  But in any event, the Supreme Court does not seem to be so sensitive to the use of &quot;judge&quot; for former federal judges.  In Zelman v. Simmons-Harris, which was argued by former federal judge Marvin Frankel, Mr. Frankel was addressed three times from the bench as &quot;Judge Frankel.&quot;  No one seemed to think that this was inappropriate.
