Did the SG support the application? My understanding was that the government had filed a "statement of interest" in either the district or circuit court (or both), supporting the initial TRO application or the appeal from the denial (or both). In light of excerpts I've read of the Schindler's stay application, their filing didn't strike me as reflecting the tone used by experienced Supreme Court practitioners, and it occurred to me that the Court might be favorably impressed if the SG were to argue in more measured tones that this particular public law warranted a stay pending a trial de novo.
