Alas, I was hoping the Court would shed a little more light on which cases should be stayed and which should not. They have only stayed Emmett "pending final disposition of the appeal by the United States Court of Appeals for the Fourth Circuit...." The Fourth could summarily affirm tomorrow, terminating the stay. Presumably they decided the appeal had no merit before they denied the stay. See Barefoot v. Estelle, 463 U.S. 880 (1983).
