On Wednesday, in CSX Transportation, Inc. v. Alabama Department of Revenue, the Court will address a dispute over a tax which was imposed on diesel fuel purchased or consumed by rail carriers, but was not imposed on two rail carrier competitors. Michele LaForest Halloran, a clinical professor of law at Michigan State University College of Law in East Lansing, Michigan, previews the case for the American Bar Association’s PREVIEW of U.S. Supreme Court Cases; the ABA has generously agreed to share some of its previews – which are authored by practitioners and scholars in the field – with SCOTUSblog.
