Issue: Whether the Pennsylvania Higher Education Assistance Agency, a statewide agency located in the capital and unambiguously treated as an arm of the state by Pennsylvania, is an arm of Pennsylvania for purposes of federal law, or is instead an “independent political subdivision” as determined by the Fourth Circuit and its multifactor balancing test.
