Wednesday round-up

In an op-ed for The New York Times, William Baude urges the Court to provide more information regarding the orders that it issues, arguing that, with “[t]he court . . . in the spotlight more and more, “[t]ransparency in all its decisions is vital to its continued legitimacy.”  Rick Hasen weighs in at his Election Law Blog, suggesting that – unlike the lower courts – “[t]he stakes at the Supreme Court are higher, and the guidance more sorely needed on a national basis.”

Briefly:

  • In USA Today, Richard Wolf looks at the Justices’ views on statutory interpretation and what they might mean for King v. Burwell, in which the Court will consider whether individuals who purchase their health insurance on an exchange established by the federal government are eligible for tax subsidies for those purchases.
  • At The Economist’s Democracy in America blog, Steven Mazie describes a “tack some states are taking to dull the sting of a Supreme Court ruling on same-sex marriage” – casting the issue “as a matter of religious conscience” – and concludes that it is “less obviously a losing strategy.”
  • At Talking Points Memo, Sahil Kapur reports on the possibility of “[a] perfect storm of a White House and Senate controlled by the same party with a Senate minority threatening to filibuster a Supreme Court nominee.”
  • Today at 4 p.m. Justice Ruth Bader Ginsburg will speak at the Georgetown University Law Center; C-SPAN Radio will air the event live at 90.1 FM in the Washington, DC area, online at www.c-span.org and nationwide on XM Satellite Radio, channel 120.
