Petition of the day
The petition of the day is:
Issue(s): (1) Whether, when the suspect in custody makes an ambiguous or equivocal reference to counsel before receiving Miranda warnings, “clearly established Federal law” as determined by this Court forbids the police from advising the suspect of his Miranda rights and then conducting an interrogation after he waives them; and (2) whether, under the “highly deferential” standard of review set out in 28 U.S.C. § 2254(d), it was objectively unreasonable for the state court to conclude that respondent did not unambiguously and unequivocally invoke his right to counsel before receiving Miranda warnings.
