Wednesday round-up

The Hazleton Standard Speaker reports that that the Third Circuit recently vacated its earlier decision in Lozano v. Hazleton, in which it had deemed unconstitutional an immigration ordinance enacted by the City of Hazleton, Pennsylvania.  The Third Circuit will now reconsider the case in light of the Court’s decision earlier this year in Chamber of Commerce v. Whiting, rejecting a constitutional challenge to a similar Arizona law.  As James noted on Monday, affirmative action could be back before the Court during its next Term. Writing for the ABA Journal, Debra Cassens Weiss briefly summarizes the Fifth and Sixth Circuit cases on the constitutionality of affirmative action programs in Texas and Michigan, respectively.

Briefly:

  • The website Legal Newsline summarizes a Federalist Society Term-in-review event that was moderated by former Solicitor General Paul Clement.
  • The Portland Press Herald and the Kennebec Journal report that the Chief Justice recently spoke at a lunch to commemorate the two-hundredth anniversary  of a Maine law library.
