Argument preview: Deference for ineffective assistance claim denials under AEDPA

On Tuesday, in Harrington v. Richter, the Court will hear oral argument regarding whether a state court’s denial of a defendant’s ineffective assistance claim warrants deference under the Antiterrorism and Effective Death Penalty Act, and, if so, whether habeas relief is appropriate in this particular dispute.  John P. Elwood and Douglas D. Geyser of Vinson & Elkins LLP preview the case for the American Bar Association's PREVIEW of U.S. Supreme Court Cases; the ABA has generously agreed to share some of its previews "“ which are authored by practitioners and scholars in the field "“ with SCOTUSblog.  You can read Mr. Elwood and Mr. Geyser’s preview here; PREVIEW's website is here.
