Today at the Court

At 10 a.m., the Court is expected to release opinions, and we will be “live” blogging for the occasion.

The Court will then hear oral argument in New Process Steel v. National Labor Relations Board (08-1457).  At issue in the case is whether, when the five-member NLRB has properly delegated its authority to three of its members, two of those three members can constitute a quorum for the purpose of decision-making by the Board.  Dina Guzovsky, a Harvard Law School student, previewed the case last week for SCOTUSblog.
