SG recommends grant in sovereign immunity case, denial in preemption cases

Late last week, the federal government recommended the Court grant certiorari in Republic of Iraq v. Beaty (07-1090), involving federal court jurisdiction over claims against Iraq for conduct that occurred under Saddam Hussein. The Solicitor General also recommended the Court deny certiorari in Weldon v. Norfolk Southern Railway Company (07-1152) (brief here), involving an Ohio law that imposes filing requirements on asbestos-related claims, and Albertson’s v. Kanter (07-1327) (brief here), invovling a class action suit over grocery stores’ alleged failure to label farm-raised salmon as artificially colored.
