Ninth-circuit-bashers, including the Supreme Court, fail to take into account that the Ninth Circuit sees tens of cases involving a given subject matter for each one heard in another circuit, let alone the Supreme Court, and as a result has a more nuanced view of legal issues than other circuits. Today’s argument in Dada shows that in spades. The justices couldn’t even get the procedural posture straight, let alone consider the variety of circumstances in which motions to reopen can arise or the multiplicty of types of relief that they can seek. A Ninth Circuit Judge has to decide an immigration case every day before breakfast just to keep up. The Ninth Circuit has written a practice guide for immigration cases (see their website) which is much more enlightening than the Supreme Court’s opinion will be. Of course, the Court controls its own docket, so it will never be flooded with immigration cases the way the circuit courts are, but it will be interesting to see if the justices withrdraw, bloodied, from the field when they discuss Iouri v. Mukasey in conference Friday.
