		<description>The decision in Central Virginia Community College v. Katz shows that the four Justices in the minority don&#039;t stoop to political games--at least, not this time. Any one of them could probably have manipulated the process to delay the decision until after Justice O&#039;Connor&#039;s retirement. As Marty notes, that almost certainly would have resulted in the case turning out the other way, on the assumption that Justice Alito would vote with the conservatives.
