		<description>Separating the &quot;threshold&quot; determination from other aspects of eligibility for the death penalty (i.e., statutory aggravating factors) is bizarre.  It will be interesting to see if the government appeals this order.  In any event, this illustrates once again the need to amend the federal death penalty statute to more cleanly separate eligibility and selection in the post-Ring world.
