Padilla
Howard Bashman has posted the government’s opening Fourth Circuit brief in the Padilla case. Padilla’s petition for cert. before judgment — which seeks to jump over the Fourth Circuit entirely — is pending in the Supreme Court as No. 04-1342. Lyle previously wrote about the petition — with a hat tip to Howard for posting it — here.
The government’s response to the petition was due yesterday. If we can track down a copy, we will post it.
(NOTE: The Fourth Circuit has scheduled oral argument on the government’s appeal on July 19. Padilla’s brief is due June 7. The case is being expedited.)
For what it’s worth, the Office of the Solicitor General has finally posted the Government’s brief in opposition to Padilla’s petition to the Supreme Court. It can be found here:
